New York City Comptroller William C. Thompson, Jr. today issued an audit finding that the Brooklyn Baseball Company (BBC), owner of the Brooklyn Cyclones, failed to pay the City more than $129,000 due to underreporting attendance, use of its recreation area, and shared special event income.
“The City should be fairly compensated,” Thompson said. “I urge the New York City Department of Parks and Recreation to pursue the full audit assessment of $129,692.”
The audit – which can be viewed at www.comptroller.nyc.gov - spanned November 1, 2004 to October 31, 2006. As a result of the audit, BBC has only paid the City $20,336 to date.
On June 1, 2001, BBC and the New York City Department of Parks and Recreation entered into a 20-year lease agreement which gives BBC the exclusive right to use KeySpan Park on Surf Avenue in Brooklyn. The lease allows BBC to sell game tickets, operate a team store, sell ads, provide food and souvenir concessions, operate or sublease retail space on Surf Avenue and lease the stadium for special events.
Under the lease, BBC is required to annually pay rent to the City based on actual game attendance, a per ticket fee based on actual attendance for the use of the recreation area, and for paid no-shows (persons who bought tickets but didn’t attend the game). BBC also must pay monthly rent for the team store, deposit $27,670 each year into a sinking fund that permits Parks to perform capital projects at the stadium, and pay utility costs, among other lease requirements.
